KAROO NEWS - The accused in the so-called insurance murder case, Nomphelo Maloyi (36) and Lwazi Kay (35), appeared before court again on Monday 28 August. It is alleged that Maloyi paid Kay to kill her 66-year-old uncle, Mynhardt Maloyi, for the payout of a life insurance policy.
They were arrested in November last year and appeared before court for the first time on 12 December 2022 - both were denied bail and remained in custody.
Bail applications
Maloyi and Kay applied for bail again earlier this year and their bail applications were heard for the first time on 24 April. The state opposed both bail applications primarily based on the nature and extent of the crimes allegedly committed. Specific concerns relating to the safety of the public and the investigating officer, Monwabisi Morley, who was called as a witness for the prosecution were also put forward by the state. In addition, public sentiment about the case, and the fact that Maloyi may pose a flight risk, were raised.
It was also noted by Morley that Maloyi may attempt to take her own life to avoid having to face the consequences of her alleged illegal actions. Following several postponements of their bail hearings, both accused's bail applications were denied on 23 June.
Further investigation
Maloyi and Kay will appear before court again on 15 September. The case was postponed for further investigation since the District Public Prosecutor is awaiting additional information in order to determine whether it should be heard in the regional court or referred to the High Court.
