KAROO NEWS - Lwazi Kay (35) and Nomphelo Maloyi (36) will be back in court on Monday 15 May, after they appeared on Thursday 4 May, for the continuation of their bail application hearing.
Maloyi and Kay are charged with the premeditated murder of Moloyi's 66-year-uncle, Mynhardt Maloyi, in November last year, allegedly for the pay-out of a life insurance policy.
Their bail applications were heard for the first time on 24 April before Magistrate Nontutuzelo Mabenge.
Zolile Ngqeza from Gqeberha who represents Maloyi, indicated that Maloyi will be able to pay bail in the amount of R5 000 and Nkosazana Gxumisa of Legal Aid SA who represents Kay, said Kay will only be able to pay bail of R500. Both legal representatives put forward some factors in support of their respective clients' bail applications. The state opposed both bail applications, primarily based on the nature and extent of the crimes.
Testimony was heard from the investigating officer, Detective Monwabisi Morley, who was called as witness for the prosecution.
Specific concerns relating to the safety of the public and the investigating officer, public sentiment about the case, and the fact that Maloyi may pose a flight risk were raised. In addition, it was noted that Maloyi may attempt to take her own life to avoid having to face the consequences of her alleged illegal actions.
On Monday Morley will be cross-examined by Zolile Ngqeza.
Ngqeza previously objected to Morley's testimony relating to the way in which the murder was committed as it was based on a confession made by Kay and, according to Ngqeza, a confession made by a co-accused is inadmissible. However, after it was confirmed that the testimony is supported by witness statements, Morley was allowed to continue testifying.
