Update
GRAAFF-REINET NEWS - The accused in the so-called “insurance murder” case, Lwazi Kay (35) and Nomphelo Maloyi (36), appeared before court again on Thursday 4 May, for the continuation of their bail application hearing.
Maloyi and Kay are charged with the premeditated murder of Moloyi’s 66-year-uncle, Mynhardt Maloyi in November last year – in an alleged case of murder for money.
Their bail applications were heard for the first time on 24 April before Magistrate Nontutuzelo Mabenge.
Testimony was heard from the investigating officer, Detective Monwabisi Morley, who was called as witness for the prosecution. The bail hearing was postponed until next Monday 15 May when Morley will be cross-examined by Zolile Ngqeza from Gqeberha who represents Maloyi.
Ngqeza previously objected to Morley's testimony as it was based on a confession made by Kay and, according to Ngqeza, a confession made by one accused is inadmissible against his co-accused.
However, after it was confirmed that the testimony is supported by witness statements, Morley was allowed to continue testifying.
